Terms and Conditions

Please note that the following terms and conditions outline the agreement between you (the client) and PhotoBomb. By booking and using our photo booth services, you agree to adhere to these terms and conditions:

  • Booking and Payment: a. A non-refundable deposit is required to secure your booking. The deposit amount will be communicated to you during the booking process. b. Full payment for the services must be made prior to or on the day of the event, unless otherwise agreed upon in writing. c. Payment can be made via cash, credit/debit card, or other agreed-upon methods. Any additional charges incurred during the event (e.g., extra hours, customizations) must be paid in full before the conclusion of the event.
  • Service Duration: a. The photo booth services will be provided for the agreed-upon duration specified in the booking. b. If you require an extension of the service duration during the event, additional charges may apply. Extension requests are subject to availability and must be confirmed by our team.
  • Event Setup and Requirements: a. The client must provide a suitable and safe location for the photo booth setup, with access to a standard power outlet. b. It is the client’s responsibility to ensure that the venue grants permission for the photo booth setup and operation. c. Adequate space must be allocated for the photo booth setup, as specified by our team. d. The client is responsible for any parking fees or additional charges incurred by our team while accessing the event venue.
  • Use of Images and Data: a. By using our photo booth services, you grant us permission to use the event photos for promotional purposes, including but not limited to social media, website, and marketing materials. If you wish to restrict the use of certain photos, please notify us in writing before or during the event. b. We respect your privacy and will handle any personal data collected during the event in accordance with our privacy policy. We will not share or sell your data to third parties without your consent.
  • Guest Conduct: a. The client is responsible for the behavior and conduct of their guests and attendees at the event. Any damage caused to the photo booth or equipment due to guest negligence or misconduct will be the client’s financial responsibility. b. Our team reserves the right to refuse service to any guest or attendee who behaves inappropriately or violates the event venue’s rules and regulations.
  • Equipment Malfunction and Liability: a. While we take every precaution to ensure the reliable operation of our photo booth equipment, technical issues or equipment malfunctions may occur. In the event of such issues, we will make reasonable efforts to repair or replace the equipment in a timely manner. b. Our liability is limited to the amount paid for the photo booth services. We will not be held responsible for any consequential damages or losses resulting from equipment malfunctions or unforeseen circumstances.
  • Cancellations and Refunds: a. In the event of a cancellation by the client, the non-refundable deposit will not be returned. b. Cancellations made within a specific timeframe (as specified in the booking agreement) may require additional payment or incur a cancellation fee. c. Refunds for cancellations made outside of the specified timeframe are subject to our discretion.
  • Force Majeure: a. We will not be held responsible for any delays or failures in service due to circumstances beyond our control, including but not limited to natural disasters, severe weather conditions, power outages, or government restrictions.

Booking Agreement

This booking agreement (“Agreement”) is made between PhotoBomb (“Provider”) and the client (“Client”) for the provision of photo booth services. By confirming the booking and making a payment, the Client agrees to the terms and conditions outlined below:

  • Booking Confirmation: a. The booking is considered confirmed once the Client has provided all necessary event details and paid the required deposit. b. The Provider will send a confirmation email or written communication to acknowledge the booking.
  • Service Details: a. The Client agrees to provide accurate event details, including date, start time, and duration of service. b. Any changes to the event details must be communicated to the Provider in writing and are subject to availability.
  • Payment: a. The Client agrees to pay a non-refundable deposit, as specified by the Provider, to secure the booking. The deposit amount will be communicated during the booking process. b. The remaining balance must be paid in full prior to or on the day of the event, unless otherwise agreed upon in writing. c. Failure to make payment in accordance with the agreed terms may result in the cancellation of the booking.
  • Cancellations and Refunds: a. In the event of a cancellation by the Client, the deposit paid is non-refundable. b. Cancellations made within a specific timeframe (as specified in the booking agreement) may require additional payment or incur a cancellation fee. c. Refunds for cancellations made outside of the specified timeframe are subject to the Provider’s discretion.
  • Service Provision: a. The Provider will make reasonable efforts to deliver the agreed-upon photo booth services in a professional manner. b. The Provider will arrive at the event venue at least 1 hour minutes before the agreed start time to set up the photo booth. c. The Provider reserves the right to substitute equipment or props of equal quality and value, if necessary.
  • Client Responsibilities: a. The Client agrees to provide a suitable and safe location for the photo booth setup, with access to a standard power outlet. b. It is the Client’s responsibility to ensure that the venue grants permission for the photo booth setup and operation. c. The Client shall be responsible for any damage caused to the photo booth or equipment due to guest negligence or misconduct.
  • Liability: a. The Provider will not be liable for any injuries, damages, or losses incurred during the event, except where such incidents are a direct result of the Provider’s negligence or willful misconduct. b. The Provider is not responsible for any consequential damages or losses resulting from equipment malfunctions, unforeseen circumstances, or force majeure events.
  • Intellectual Property: a. The Client acknowledges that all intellectual property rights related to the photo booth services, including but not limited to photographs, prints, and digital images, are owned by the Provider. b. The Provider grants the Client a non-exclusive, non-transferable license to use the images for personal or non-commercial purposes.
  • Privacy: a. The Provider will handle any personal data collected during the event in accordance with applicable privacy laws and its privacy policy. b. The Provider will not share or sell the Client’s personal data to third parties without the Client’s consent.
  • Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of Jamaica. Any disputes arising from or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Jamaica.

By confirming the booking and making a payment, the Client acknowledges that they have read, understood, and agreed to the terms and conditions outlined in this Agreement.
